such, they are being disposed of by a common order.

Heard the parties.

Petitioners have been made accused in connection with Gidhour P.S. Case No. 31 of 2025, for the offences registered under Sections 18(b), 22(c), 27(a), 28 & 29 of the N.D.P.S. Act and Section 111(2)(b) of the B.N.S. 2023, pending in the Court of learned Sessions Judge-cum-Special Judge (NDPS Cases), Chatra.

Bail application of petitioner Jitendra Kumar @ Jitendra Thakur has been rejected by this Court earlier vide B.A. No. 6791 of 2025 by order dated 05.08.2025.

On 06.05.2025, Gidhour police on the basis of confidential information raided house of several persons and recovered opium from there. It appears that on the confession of petitioner Jitendra Kumar @ Jitendra Thakur, house of petitioner Rajesh Dangi was searched and from there, 1.58

kilograms of opium were recovered. It further appears that from the house of petitioner Mithlesh Kumar, 1.87 kilograms of opium were recovered.

It was submitted that separate seizure list was prepared. It was further submitted that the opium so recovered were not recovered from joint possession of the parties.

Ms. Nehala Sharmin, learned Spl. P.P. appearing for the State has submitted that petitioner Rajesh Dangi is involved in two criminal cases, out of which, one is of similar nature.

Mr. Fahad Allam, learned counsel appearing for the State has submitted that petitioner Mithlesh Kumar @ Mithilesh Kumar is also involved in one case of similar nature.

Mr. Bhola Nath Ojha, learned Spl. P.P. appearing for the State has submitted that petitioner Jitendra Thakur @ Jitendra Kumar has got no criminal antecedent.

In view of the aforesaid facts, I am not inclined to enlarge the petitioners, Mithlesh Kumar @ Mithilesh Kumar and Rajesh Kumar @ Rajesh Dangi on bail. Accordingly, their prayer for bail is rejected.

So far as petitioner Jitendra Thakur @ Jitendra Kumar is concerned, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Gidhour P.S. Case No. 31 of 2025, in connection with Sessions Judge-cum-Special Judge (NDPS), Chatra.
