Heard learned counsel in I.A. No.841 of 2024 which has been filed for withdrawal of instant Second Appeal as the matter has been settled and settlement deed has been filed duly signed by both sides on 29th December, 2023 wherein it has been agreed that respondent will pay a sum of Rs.7,15,000/- to the appellant. In pursuant to this agreement, the agreed amount has already been received. Therefore, the appellant is not interested in pursuing the instant appeal.
Under the circumstance, instant appeal is dismissed as withdrawn. I.A. No.841 of 2024 is allowed.
