Petitioner is apprehending his arrest in connection with Ramna P. S. Case No. 69/2023, registered under Sections 323/ 362/ 354/ 376/ 379/ 504/ 506 of the Indian Penal Code, pending in the Court of learned A.C.J.M., Nagar Untari, Garhwa.
Initially a complaint case was filed by the opposite party no. 2, alleging therein that the petitioner had ravished her and snatched her ornaments. Subsequently, this complaint case was referred to police station for institution of FIR.
It was submitted that the present case was filed due to dispute of payment due to the prosecutrix and now the parties have settled the dispute.
Learned lawyer appearing on behalf of the opposite party no. 2 has conceded this fact.
Regard being had to the facts and circumstance of the case; I am inclined to extend the privilege of Anticipatory Bail to the petitioner. He is directed to surrender before the court below within two weeks from the date of receipt of copy of this order and learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nagar Untari, Garhwa in connection with Ramna P. S. Case No. 69/2023, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
