Petitioner is apprehending his arrest in connection with Dhurki P.S. Case No. 69 of 2023, for the offences registered under Sections 498A, 323, 379, 504, 506/34 of the Indian Penal Code and Section 3 /4 of the Dowry Prohibition Act, pending in the Court of learned A.C.J.M., Nagar Untari, Garhwa.
Notice was issued for the appearance of Opposite party No. 2. It transpires from the service report that notice has validly been served upon the Opposite Party No. 2, but she is unrepresented.
Accordingly, this Anticipatory Bail Application is disposed of after hearing learned counsel for the petitioner and the learned A.P.P on behalf of the State.
Learned counsel for the petitioner submitted that petitioner is the husband of the Opposite Party No. 2. It was further submitted that Opposite Party No. 2 has not sustained any injury at the hands of the petitioner.
Mr. Praful Jojo, learned A.P.P. has opposed the prayer for bail, but does not dispute the facts that the Opposite Party No. 2 has not sustained any injury at the hands of the petitioner.
Considering the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner, above named, is directed to surrender before the learned court below within two weeks from the date of receipt of a copy of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Nagar Untari, Garhwa in connection with Dhurki P.S. Case No. 69 of 2023, subject to the conditions
as laid down under section 438(2) of the Code of Criminal Procedure.
