Petitioners are apprehending their arrest in connection with C.P Case No. 857 of 2020 for the offences registered under sections 427, 447, 406, 420, 120-B/34 of the Indian Penal Code, pending in the court of Sri Mahendra Pandit, learned Judicial Magistrate, 1^st Class, Dhanbad.

It is alleged that the complainant had purchased the land from coaccused Rajesh Mahto for a consideration amount of Rs. 12.00 lakhs. It is further alleged that later on, Rajesh Mahto sold the land to somebody else.

Allegation against the petitioners is that they are the witnesses to the sale deed.

Mr. Shekhar Prasad Sinha, learned counsel appearing for the petitioners, submitted that no money was given to the petitioners. It is further submitted that they are not the owner of the land and similarly situated co-accused Sanjay Kumar Rawani has been granted anticipatory bail by a Coordinate Bench of this Court vide A.B.A. No. 505 of 2023.

Mr. Sanjay Kumar Pandey, learned counsel appearing for the opposite party no. 2, has vehemently opposed the prayer for bail and submitted that accused persons had demolished the boundary wall given by the complainant.

Considering the submissions made on behalf of the petitioners, I am inclined to extend the privilege of anticipatory bail to the petitioners. Accordingly, petitioners, above named, are directed to surrender before the learned court below within two weeks from the date of receipt of a copy of this order and the learned court below on their surrender, shall release them on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty-five thousand) each, with two sureties of the like amount each, to the satisfaction of Sri Mahendra Pandit, learned Judicial Magistrate, 1^st Class, Dhanbad in connection with C.P
