1. Heard learned counsel for the applicant and learned A.P.P.

2. The applicant, who is in custody since 11.03.2022, has renewed his prayer for grant of regular bail in connection with Garhwa P.S. Case No.583 of 2021, corresponding to G.R. No.762 of 2022, registered for the offence under Sections 380/ 457/ of the Indian Penal Code. The case is now pending in the court of learned C.J.M., Garhwa.

3. It appears that theft has been committed by unknown miscreants in a locked house. The F.I.R has been lodged against unknown and this applicant has been roped in on the basis of confession.

4. Learned counsel for the applicant claims innocence of the applicant and it has been submitted that this applicant has given undertaking to participate in the trial. Three criminal antecedents have been reported against this applicant but he has been enlarged on bail in all the three cases. It has further been submitted that the applicant earns his livelihood by working in a garage.

5. On the other hand, learned counsel for the State has opposed the prayer for bail.

6. Considering the period of custody, I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Garhwa in connection with Garhwa P.S. Case No.583 of 2021, corresponding to G.R. No.762 of 2022, on the condition that the applicant will mark his attendance before the concerned Police Station, once in a month, till the conclusion of

the trial and further he will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
