Heard learned counsel for the applicant and the learned A.P.P. for the State.

This bail application has been filed on behalf of the applicant-Ankush Kumar Thakur @ Ankush Kumar with the prayer to release on bail in connection with Mahagama P.S. Case No. 102 of 2024, corresponding to N.D.P.S. Case No. 13 of 2024, registered under Section 20 (b)(ii) B & 22 of the N.D.P.S. Act, 1985, pending in the Court of the learned Sessions Judge, Godda.

As per allegations made in the F.I.R. one motorcycle was intercepted by which two persons were going. One was apprehended at the spot and another managed flee away. The apprehended person was identified Ankush Kumar Thakur @ Ankush Kumar and from his possession 2.4 k.g. Ganja is alleged to have been recovered.

The Ganja which is recovered from the possession of petitioner is below the commercial quantity. As per seizure

memo there is no independent witness of the same. The petitioner has been languishing in Jail since 20.06.2024 having no criminal antecedent.

In view of the above, the bail application of the petitioner is allowed. Let the applicant be released on bail on furnishing bail bond of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in the aforesaid case.
