Heard learned counsel for the petitioner and learned APP for the State.

This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with Tamar P.S. Case No.47 of 2023 registered under section 379, 411, 467, 468, 471, 413, 414, 34 of I.P.C., pending in the court of learned Judicial Magistrate, Ranchi.

The FIR of this case was lodged against three named accused including the present petitioner with these allegations that the informant along with police force was on patrolling duty and a Herohonda Splendor Motorcycle without number plate was intercepted. On 26.05.2023 at 14:50 Hrs., two persons were apprehended, who were identified as Rakesh Ahir and Nilambar Ahir. It was disclosed by Rakesh Ahir that the said motorcycle was stolen along with Niranjan Ahir and was going along with Nilambar Ahir to sell the same, hence this FIR was lodged.

Though the name of petitioner figured in the FIR on the disclosure made by the apprehended accused Rakesh Ahir; yet he was neither apprehended at the spot nor any incriminating article was recovered from his possession. His name figured in the FIR on the disclosure made by the co-accused Rakesh Ahir. The petitioner has been languishing in jail since 20.10.2023.

In view of the above, the bail application of the petitioner is hereby allowed. Let the petitioner be released on bail on furnishing bail bond of Rs. 15,000/- (Rupees Fifteen thousand) with two sureties of like amount to the satisfaction of the court concerned in the aforesaid case.
