Heard learned counsel for the petitioner.

This bail application has been filed on behalf of Prabhat Kumar Yadav @ Afjal @ Marandi @ Abhishek Jee with a prayer to release on bail in connection with Manika P.S. Case No. 14 of 2023, corresponding to G.R. Case No. 343 of 2023, registered under Sections 341, 342, 504, 506, 435, 385, 387, 34 of the Indian Penal Code and under Section 27 of the Arms Act and 17 of C.L.A. Act, pending before the Court of learned A.C.J.M, Latehar.

As per allegations made in the FIR, the informant, a contractor, made allegations with these effects that the construction work was going on. On 21.02.23, three unknown miscreants came telling themselves to be the members of Organization of Extremist and asked to stop the construction work. They also criminally intimidated the driver, namely, Lal Bacha Yadav and the machine for construction work was also damaged by setting the same on fire. Hence, this FIR was lodged.

The learned counsel for the petitioner has submitted that this FIR was lodged against the unknown miscreants. The name of the present petitioner transpired in confessional statement of co-accused, namely, Nikki Yadav @ Akash Yadav @ Mukhiya @ Ganga who has been granted bail in B.A. No. 10038 of 2023 vide order dated 18^th December, 2023 by a Co-ordinate Bench of this Court and the case of the present petitioner is identical. So far as the criminal antecedent is concerned, he has three criminal antecedents of three cases and in all the three, he is already on bail.

In view of the above, the bail application of the petitioner/applicant is hereby allowed. Let the petitioner/applicant be released on bail on furnishing bail bond of Rs. 15,000/- (Rs. Fifteen Thousand Only) with two sureties of the like amount to the satisfaction of the Court concerned in the aforesaid case.
