Heard learned counsel for the applicant and the learned A.P.P. for the State.

This bail application has been filed on behalf of the applicant- Dipak Chaudhary @ Teka Chaudhary @ Teka @ Deepak Chaudhary with the prayer to release on bail in connection with Jarmundi P.S. Case No. 54 of 2023, corresponding to S.T.No.27 of 2024, registered under Section 302/34 of the Indian Penal Code and 27 of Arms Act, 1959, pending in the Court of the learned Additional Sessions Judge-IV, Dumka.

The F.I.R. of this case was lodged against five named accused including the present petitioner and 8-10 unknown persons in regard to commission of murder of Amarnath Singh on 27.07.2023. It was Manish Singh and Brajesh Singh who

had seen the assailant fleeing away after committing murder and on the basis of C.C.T.V. footage 05 persons were named in the F.I.R.

In view of para 8 Satyendra Kumar Yadav, para 10 Manish Kumar, para 12 Brajesh Kumar Singh and para 14 Premlata Devi of the case diary have stated that they have seen the C.C.T.V. footage wherein the occurrence took place. It was Vishal Singh, Uttam Mahto and Ajeet Mandal all the three in disguise of Kawariya had shot to Amarnath Singh while Deepak and Raja Sharma were guarding there. In this case trial has also commenced.

P.W.1-Ashutosh Ojha, P.W.2-Brajesh Kumar Singh, P.W.3-Lalit Sharma, P.W.4-Rina Devi and P.W.5-Satyendra Kumar Yadav all the five have turned hostile and have not corroborated the prosecution story. So far as Premlata Devi is concerned, she has also attributed role to the present petitioner of guarding there.

In view of the above, the bail petition of the petitioner is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five

Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in the aforesaid case.
