This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with Karanj P.S. Case No.01 of 2024 registered under Sections 379, 411, 364, 302, 201, 120B/34 of the Indian Penal Code pending in the court of learned SubDivisional Judicial Magistrate, Gumla.

The F.I.R. of this case was lodged against five named accused including the petitioner and two unknown miscreants with these allegations that in the evening of 24^th December, 2023, the informant’s husband, on telephone, had informed that he is going to Darha Sisai in connection with loading goods for Daltonganj and since, thereafter, her husband is missing. She further alleged that through GPS, the vehicle of her husband bearing registration No. JH 01 EY 7256 is found parked at Chitagutu in the courtyard of Sanjay Munda @ Jogia Munda. On query from mother of Sanjay Munda @ Jogia Munda, she disclosed that her son and their friends, namely, Shiv Kumar Singh (the petitioner), Gandadhar Singh @ Gangu, Rohit Kumar Verma and Ashish Verma @ Chiku and two other boys had brought the said Pick-Up vehicle along with a white colored Alto car. She also alleged that earlier Shiv Kumar Singh (the petitioner) due to land dispute had threatened her husband. Hence, this F.I.R. was lodged. 4. During course of investigation, the co-accused Rohit Kumar Verma was apprehended and he disclosed that Dilip Singh (the husband of the informant) had been murdered by strangulating his neck with a cloth made rope as well as by crushing his head by stones and his dead body was buried at the bank of river situated under Bangru forest.

From the very allegations made in the F.I.R., the Pick-Up van of the

deceased was recovered from the house of Sanjay Munda @ Jogia Munda and as per statement of mother of Sanjay Munda, the said Pick-Up Van along with a Alto car was brought by Sanjay Munda and his friends who are named in the F.I.R. including the present petitioner. As per paragraph 14 of the case-diary, on the basis of confessional statement of co-accused Rohit Kumar Verma, the dead body of the husband of the informant was recovered. The name of the petitioner figured in the F.I.R. on the disclosure statement made by the apprehended co-accused Rohit Kumar Verma.

Considering the aforesaid facts and circumstances of the case, the bail application of the petitioner is, hereby, allowed. Let the petitioner be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
