This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with S.T. Case No.89 of 2023 arising out of Murhu P.S. Case No.65 of 2022 registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act pending in the court of learned Additional Sessions Judge-III, Khunti.

The F.I.R. of this case was lodged by the wife of the deceased with these allegations that her husband Kishun Pahan had illicit relation with the wife of Budhram Munda, namely, Tuni Mundain. On the very issue, there was strained relation between her and Tuni Mundain as well. On 21^st June, 2022 at 7 o’ clock, 10 persons had gone to village Sarungda for worship on a tempo and at 11.00 p.m. wife of Khudiya Pahan informed her that some occurrence took place at village Buruma. Thereafter she along with other villagers reached there and saw the dead body of her husband. The blood was oozing from his left shoulder. It came to know that two unknown persons had come by the motorcycle and they asked the name of the husband of the informant and got him alighted from the tempo and shot him. It appeared that Budhram Munda and his associates had committed murder of her husband. Hence, this F.I.R. was lodged. 4. This F.I.R. was lodged by the informant on the basis of suspicion only, since her husband had the illicit relation with the wife of the Budhram Munda. No one, who were boarding in the tempo along with the deceased at the time of occurrence had disclosed the name of the assailants. During investigation, no TIP was conducted to identify the accused persons by

those persons, who were boarding in the very tempo at the time of incident.

In view of the above, the bail application of the petitioner is, hereby, allowed. Let the petitioner be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
