Heard learned counsel for the petitioner and learned APP for the State.

This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with Giridih (M) P.S. Case No.155 of 2024 registered under sections 405, 420, 464, 465, 467, 468, 471, 474 and 120-B of I.P.C., pending in the court of learned S.D.J.M., Giridih.

The FIR of this case was lodged by the informant Pawan Kumar with these allegations that on 22.03.2024, Manish Kumar Karan, the petitioner herein told him by way of Instagram that for government job in Jharkhand Education Project Council, there is post of E-Kalyan and Data Management Operator, on payment of money, the job will be given. He made demand of Rs.5 lakhs, thereafter, he said that firstly pay Rs.2,50,000/- and rest of the amount was to be paid after obtaining the job. The informant and his associate Pursottam Kumar Patwa and Kailash Jaiswal altogether have paid Rs.7,50,000/- from 22.03.2024 to 04.05.2024 by way of Phonepe to Manish Kumar Karan. He also stated that certain documents would be verified. The date of interview was also apprised to be 21.04.2024 but no interview was held and directly on the basis of merit list, selection was done. The joining letter was given, in which, it was mentioned in between 29.04.2024 and 03.05.2024, the joining was to be given in the D.C. Office, Paparwatand, Giridih. The informant reached there, where he introduced with one persons Awinash Kumar, who further asked him for biometric presence along with I.D. Card, whereby he doubted to the accused Manish Kumar Karan, on having become annoyed, Manish Kumar Karan gave a cheque of Ashok Patra, which was bounced being forged. It is further alleged that the amount of Rs.12 lakhs was demanded by the petitioner-accused from Surendra Vishwakarma, in which Rs.2,50,000/- was asked to be given prior to the job and rest amount was to be paid on obtaining job. Thereafter, the informant came to know that by way

of UPI from 10.01.2024, Rs.1 lakhs and Rs.1,50,000/- were also paid to Manish Kumar Karan, on which, affidavit was given on stamp paper and one cheque was also given when that cheque was also presented before the bank concerned, the same was also bounced on 06.04.2024. This cheque was again presented before the bank and the same was also bounced and on calling the accused Manish Kumar Karan over his phone, his phone came switched off. Hence, this FIR was lodged.

The allegations made in the FIR are also being corroborated with the documentary evidence annexed with the FIR even the payment is also corroborated on those very date as stated in the FIR, which was paid by the informant and others. In view of the documents annexed with the FIR itself and also taking into consideration the statement of Kumar Priya Ranjan @ Preetam Ranjan mentioned in paragraph Nos.45 of the case diary, statement of Ranjeet Kumar Verma mentioned in paragraph No.60 of the case diary, the allegations made in the FIR are well corroborated and the involvement of the petitioner is found.

In view of the above, the bail application of the petitioner is rejected.
