Petitioner has been made accused in connection with Sessions Trial No. 575 of 2022 arising out of Jugsalai P.S. Case No. 58 of 2021 corresponding to G.R. No. 1523 of 2021 for the offences registered under sections 302/120B of the Indian Penal Code and section 27 of Arms Act, pending in the court of learned Additional Sessions Judge-II, East Singhbhum at Jamshedpur.

Bail application of the petitioner was earlier rejected vide B.A. No. 12493 of 2021 by order dated 06.12.2021 with a direction to the learned Sessions Court to conclude the trial within nine months from the first date fixed for recording of the evidence. Petitioner was given liberty to renew his prayer for bail if trial is not concluded within the aforesaid period.

It is alleged that in the year 2018, accused persons and the Informant party had gone to A.B. Palace Hotel to resolve their dispute for payment of Rs. 5.00 lakhs. There was quarrel between the parties. As the matter was not resolved, this petitioner ordered the accused Om Narayan Singh to shoot the brother of the Informant. Om Narayan Singh shot Virendra Vikram Singh brother of the Informant. He succumbed to the injury.

It was submitted that the present case was committed to the court of sessions on 03.11.2022 and charge has been framed on 06.12.2023. It was further submitted that the petitioner is in custody since 03.05.2021.

Mr. Subodh Kumar Dubey, learned A.P.P has opposed the prayer for bail.

Petitioner is in custody for more than two and half years and the petitioner is not the assailant of the deceased.

Considering the aforesaid facts, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of

learned Additional Sessions Judge-II, East Singhbhum at Jamshedpur in connection with Sessions Trial No. 575 of 2022 arising out of Jugsalai P.S. Case No. 58 of 2021 corresponding to G.R. No. 1523 of 2021.
