Yogendra Singh Alias Don Alias Don Chacha Vs the State of Jharkhand

Petitioner has been made an accused in connection with S.T. Case No. 391/ 2022, arising out of M.G.M. (Mango) P.S. Case No. 93/2021, Corresponding to G. R. Case No. 2340/2021, registered under Section 395 of the Indian Penal Code, pending in the Court of learned Additional District Judge-IV, Jamshepdur.

On the intervening night of 02/03.09.2021, unknown persons committed dacoity in the warehouse of the informant and looted away several articles’ worth rupees 53,25,472/-.

It was submitted that the petitioner was neither named in the FIR nor he was put on test identification parade, it was further submitted that nothing incriminating has been recovered from the possession of the petitioner.

From the impugned order, it transpires that name of the petitioner has come in the confessional statement of Kanhaiya Mahato who has been granted bail by co-ordinate bench of this court vide B.A. No. 439 of 2022.

From paragraph one of the present bail application it appears that the petitioner is in custody since 21.02.2022.

Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-IV, Jamshepdur in connection

with S.T. Case No. 391/ 2022, arising out of M.G.M. (Mango) P.S. Case No. 93/2021, Corresponding to G. R. Case No. 2340/2021.
