The petitioner has been made accused in connection with Chandrapura P.S. Case No.55 of 2023, corresponding to G.R. Case No.494 of 2023, for the offences under Sections 341, 323, 325 and 307/34 of the Indian Penal Code, pending in the court of learned Sub-Divisional Judicial Magistrate, Bermo at Tenughat.

On 07.05.2023 at about 6:30 P.M, the petitioner and co-accused persons assaulted the informant Gunadhar Tudu, Luku Munda and Sivan Manjhi. It appears that one of the injured has sustained grievous injury.

It was submitted that there is general allegation against the accused persons of assaulting the victims. It was further submitted that similarly situated co-accused Mantu Manjhi @ Banti Soren has been granted bail by the Coordinate Bench of this Court in B.A. No.7865/2023 and the case of the petitioner stands on similar footing. It was finally submitted that petitioner is in custody since 09.05.2023.

Learned A.P.P on behalf of the State has opposed the prayer for bail.

Considering the fact that similarly situated co-accused has been granted bail by the Coordinate Bench of this Court, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bermo at Tenughat, in connection with Chandrapura P.S. Case No.55 of 2023, corresponding to G.R. Case No.494 of 2023.
