This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with Giridih (Cyber) P.S. Case No.15 of 2024 registered under Sections 413, 419, 420, 467, 468, 471 of the Indian Penal Code and Sections 66(B), 66(C), 66(D) of the I.T. Act pending in the court of learned Additional Sessions Judge-II, Giridih.

The F.I.R. of this case was lodged against two named accused including the present petitioner on the basis of written report of the informant Punit Kumar Gautam, S.I. stating therein that on 22^nd March, 2024 at 8.30 a.m., as per the instructions of Superintendent of Police, Giridih, based on the location of mobile no.8961318264 received through Pratibimb portal, the police left from Cyber police station under the leadership of Deputy Superintendent of Police, Cyber Crime, Giridih and reached to village Jurpania, Bengabad and saw that a boy was talking on mobile at a distance of about 200 meters on the side of the main road. On seeing police party, the boy tried to run away and while running away, the said boy was apprehended. He disclosed his name as Mahendra Mandal and on search, two mobiles and three SIM cards were recovered from his possession. On checking the recovered mobile, number in the mobile was found to be 8961318264 which is the target number of Pratibimb portal. Two complaints regarding fraud have been registered against this number on the NCRP portal. On enquiry, it was told that he used to defraud money by using fake SIM cards and sending link to customers linked to CSP and he was sent jail in Cyber P.S. Case No.06 of 2020. of location of mobile no.9934005985 received through another Pratibimb portal, the team reached to village Nagar Keshwari police station Sariya and found that a boy was talking on the mobile. On seeing the police party, he tried to run away and he was apprehended. On interrogation, he disclosed his name as Ashish Mandal and during search one mobile and two SIM cards were recovered. On checking the recovered mobile, the number 9934005985 was found in the mobile which is the target number of Pratibimb portal. Two complaints regarding fraud have been registered against this number on NCRP portal. During interrogation, it was revealed that he commits fraud by obtaining details of pregnant women through Poshan Tracker App.

From perusal of the F.I.R., it is found that the mobile phone which was recovered from the possession of the present petitioner Ashish Mandal was 9934005985 and in view of paragraph 16 of the case-diary, the two victims, namely, Bhushan Mahto and Kameshwar Das were duped by this petitioner.

In view of the above, the bail application of the petitioner is, hereby, rejected.
