05/09.08.2024 Heard Mr. Prem Pujari Roy, learned counsel for the petitioner and Mr. Anil Kumar, learned A.S.G.I. appearing for the CBI.

The petitioners are apprehending their arrest in connection with R.C. Case No.6(A)/2014(D), registered for the alleged offence under Sections 120B/420/468/471 of the Indian Penal Code and under Section 13(2) read with 13(1)(d) of the Prevention of Corruption Act, pending in the Court of the learned Additional Sessions Judge-III-cum-Special Judge, CBI, Dhanbad.

Mr. Prem Pujari Roy, learned counsel appearing for the petitioners submits that the CBI has conducted the investigation and charge-sheet has been submitted on 30.06.2015 itself. He submits that the petitioners have applied for the post of CSR Junior PR cum Junior Staff Assistant S-1 Grade pursuant to advertisement published by the Bokaro Steel Plant in the newspaper and they have worked with the Bokaro Steel Plant and the

allegations are made that appointment process was not followed by the officials and further allegation against the petitioners is that the experience certificates produced by the petitioners were found to be not correct. He then submits that now the Bokaro Steel Plant has already dismissed the petitioners, which has been challenged in separate writ petition, which is pending before this Court. He also submits that the petitioners will not tamper with any evidence, in course of trial.

Mr. Anil Kumar, learned A.S.G.I., appearing for the CBI opposed the prayer on the ground that connivance of the petitioners has come in the charge-sheet and in view of that, this anticipatory bail application may kindly be rejected.

Considering that the petitioners were candidates and the officials have appointed them and the allegation is there that the experience certificates were not found correct and the petitioners have already been dismissed from service and the charge-sheet has already been submitted and during the investigation, the petitioners were not arrested and they will not tamper with the evidence during the trial and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-
