From the perusal of the office note, it transpires that notice has already been validly served to the complainant/O.P No.2, but no one present on her behalf.

Petitioner is apprehending his arrest in connection with Complaint Case No. 1064 of 2021 for the offences registered under Sections 498A of the IPC, pending in the court of learned CJM, Godda.

Learned counsel for the petitioner drew attention of this Court towards the impugned order dated 27.3.2023 passed by Additional Sessions Judge-I, Godda and submitted that petitioner is mother-in-law of the complainant/ O.P No.2 and her son, was happens to be husband of complainant is behind the bar.

Such submission has been made in presence of learned APP for the State. Learned APP further submitted that appropriate order be passed.

Heard the parties and perused the record.

From perusal of the record, it transpires that learned court has summoned this petitioner as well as her son who happens to be the husband of complainant/O.P No.2 under Section 498A of the IPC.

Considering the aforesaid fact and circumstances, this Court finds it a fit case to grant anticipatory bail to the petitioner. Accordingly, petitioner, above named, is directed to surrender before the learned court below within six weeks from the date of receipt of a copy of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten thousand) with two sureties of the like amount each, to the satisfaction of learned CJM, Godda, in connection with Complaint Case No. 1064 of 2021.
