Both these Anticipatory Bail Applications arise out of same police case. Accordingly, both these Anticipatory Bail Applications are being disposed of by a common order.

Heard the Parties.

Petitioners are apprehending their arrest in connection with Jamua P.S. Case No. 431 of 2023, for the offences registered under Sections 147/149/341/342/323/324/307/379/506 of the Indian Penal Code, pending in the court of Sri Mohit Choudhary, learned Judicial Magistrate, 1^st Class, Giridih.

It is alleged that on 21.11.2023 at about 3:00 P.M., petitioners alongwith 15 other named accused persons variously armed assaulted the informant and another person due to which they sustained injuries.

Learned counsel for the petitioners submitted that the injured persons had sustained simple injuries and this fact has been affirmed by the learned Spl.P.P. after going through the case diary.

It was further submitted that the occurrence took place due to land dispute between the parties.

Mr. Sujit Kr. Singh, learned counsel has appeared on behalf of the informant. He has vehemently opposed the prayer for anticipatory bail. He submitted that the informant and the another injured were mercilessly assaulted by the accused persons. It was further submitted that the occurrence has been found to be true under Section 307 of the Indian Penal Code.

Considering the fact that the injured persons have sustained simple injury, I am inclined to extend the privilege of Anticipatory Bail to the petitioners, named above. They are directed to surrender before the court below within two weeks from the date of receipt/production of copy of this order, and in the event of their arrest or surrender they shall be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand only) each with two sureties of the like amount each to the satisfaction of Sri Mohit Choudhary, learned Judicial Magistrate, 1^st Class, Giridih or his successor in connection with Jamua P.S. Case No. 431 of 2023. Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
