Petitioner is apprehending his arrest in connection with Bashistanagar P.S. Case No. 58 of 2023 for the offences registered under sections 414, 272, 273 and 34 of the Indian Penal Code and section 47(a) of Excise Act, pending in the court of learned Chief Judicial Magistrate, Chatra.

On 11.08.2023, Bashistanagar Police intercepted an Ertiga Car bearing registration no. BR-06AG-4580 near Ghanghri Chowk. On search, huge quantity of foreign liquor was recovered from the said vehicle.

It was submitted that name of the petitioner has come in the confession of the driver who was apprehended at the place of occurrence. It was further submitted that apart from that, there is no other material against the petitioner. It was finally submitted that the petitioner has got no criminal antecedent and this fact has been mentioned at para-15 of this anticipatory bail application.

Mr. Fahad Allam, learned A.P.P has opposed the prayer for bail and submitted that the name of the petitioner has come in the confession of coaccused.

In view of the submission made on behalf of the petitioner, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, petitioner, above named, is directed to surrender before the learned court below within two weeks from the date of receipt of a copy of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chatra in connection with Bashistanagar P.S. Case No. 58 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
