Heard learned counsel for the parties.

Apprehending his arrest in connection with Bistupur P.S. Case No. 333 of 2021 corresponding to G.R. Case No. 84/2022 registered under Sections 399/326/307 of the Indian Penal Code and Section 27 of Arms Act, the petitioner has moved this Court for grant of privilege of anticipatory bail.

As per F.I.R., allegation is that while on 15.11.2021 the informant after collecting Rs. 8 lacs reached near Ageas Federal Life Insurance Office meanwhile, one boy started snatching his bag from behind, but could not succeed then, he started threatening to the informant and they took out pistol and fired the same which caused injury on left thigh and below knee. The boy who was snatched the bag was about 35 years having blackish colour was wearing half t-shirt and another boy, who was standing on Apache motorcycle in start mode was also about 32 years and both fled away. Thereafter, informant was brought to T.M.H. Hospital for treatment and lodged this case.

Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence at all and he has no criminal background. The name of the petitioner has been surfaced in this case on the basis of confessional statement of co-accused Ram Sundar Sharma and Rajiv Sharma who were apprehended during investigation, have been granted bail and in spite of the claim of the informant to identify the miscreants and during investigation, in the CCTV Footage of this occurrence, the earlier apprehended persons were not identified. Hence, the petitioner may be extended the privilege of anticipatory bail.

Learned Addl.P.P appearing for the State has vehemently opposed the prayer for anticipatory bail of the petitioner and has submitted that the apprehended accused persons have given vivid description about involvement of the present petitioners in the alleged offence and the petitioners are required to be identified by the informant in the T.I. Parade. Hence, petitioner does not deserve anticipatory bail.

It appears that earlier the petitioner has moved before this Court for grant of anticipatory bail, but the same was dismissed as withdraw and this is the second anticipatory bail application.

Considering the facts and circumstances of this case, it appears that petitioner is required to be identified by the informant in test identification parade, I do not feel inclined to grant privilege of anticipatory bail to the petitioner, which stands rejected.
