Heard learned counsel for the parties.

Apprehending his arrest in connection with Tandwa P.S. Case No. 159 of 2022 instituted under Sections 406, 407, 420, 468, 471, 120(B) of the Indian Penal Code, the petitioner has moved this Court for grant of privilege of anticipatory bail.

As per F.I.R., the allegation is that petitioner along with accused persons were involved in a conspiracy to commit fraud by lifting coal from Aamrapali Coal Project and delivering it to M/s Rungta Mines Limited using forged documents and receiving payments. This action allegedly caused a significant financial loss amounting to Rs.64,67,507 to the company.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence at all rather he has been falsely implicated in this case. It is further submitted that this is second anticipatory bail application of the petitioner and earlier anticipatory bail application was rejected on merits by this Court, however, some other co-accused persons with similar allegations, subsequently, granted anticipatory bail by Coordinate Bench of this Court, hence, petitioner has renewed his prayer for anticipatory bail again. Petitioner undertakes to co-operate with the investigation of the case and also abide by all terms and conditions imposed by this Court in the matter of granting anticipatory bail to him. Hence, the petitioner may be extended the privilege of anticipatory bail.

Learned Addl.P.P appearing for the State has vehemently opposed the aforesaid contention and submitted that there is no fresh ground for entertaining the second anticipatory bail application which

is fit to be dismissed. Hence, petitioner may not be extended privilege of anticipatory bail.

Considering the submissions of learned counsel for the petitioner, I find that no fresh material has been brought on record to entertain the second anticipatory bail application of the petitioner Accordingly, the prayer of second anticipatory bail of petitioner is rejected.
