Heard learned counsel for the parties.

Apprehending their arrest in connection with Senha P.S. Case No. 129 of 2023 instituted under Sections 147, 148, 149, 323, 341, 324, 307, 506 of the Indian Penal Code, the petitioners have moved this Court for grant of privilege of anticipatory bail.

As per the FIR, the allegation is that there is free fight between the parties due to land dispute.

Learned counsel for the petitioners has submitted that the petitioners are innocent and have committed no offence at all as alleged in F.I.R. It is further submitted that there is case and counter case between the parties and in the counter case, all the accused i.e. informant party of this case, have been granted bail by the Police itself. It is further submitted that the petitioners undertake to abide by all terms and conditions as imposed by this Court in case of granting anticipatory bail to the petitioners. Hence, the petitioners may be extended the privilege of anticipatory bail.

Learned APP appearing for the State assisted by learned counsel for the informant has opposed the prayer for anticipatory bail of the petitioners and has submitted that the informant party has sustained injuries on head, neck and shoulder. Hence, the petitioners may not be extended the privilege of anticipatory bail.

Considering the aforesaid facts and circumstances of the case, the nature of allegation coupled with materials on record and also in view of the fact that there is case and counter case between the parties, I am inclined to grant privilege of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court within four weeks from today and in the event of their arrest or surrendering, they will be enlarged on bail on furnishing bail bond of

Rs.25,000/- (Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Lohardaga in connection with Senha P.S. Case No. 129 of 2023 with the condition that they will furnish their mobile numbers and photocopy of the Aadhar Cards with an undertaking that they will not change their mobile number during the pendency of the case and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
