BAIL - CYBER CRIME - COMMON ORDER ON THREE BAIL APPLICATIONS (B.A. Nos. 13, 14 & 24 of 2024) arising out of Jamtara Cyber Crime P.S. Case No.68 of 2023, charges under Sections 414, 419, 420, 467, 468, 471 & 120(B) of the Indian Penal Code and Sections 66(B), 66(C) & 66(D) of the Information Technology Act, pending before the Additional Sessions Judge-1st, Jamtara. Petitioners Khurshid Ansari, Salauddin Ansari and Samsher Ansari @ Shamsher Ansari were apprehended with co-accused persons, including Basir Ansari, when Jamtara Cyber Crime Police, acting on confidential information, raided his house; on search several mobile phones and other e-gadgets used in commission of the cyber offence were recovered. Submissions for petitioners: no victim had turned up to say he was cheated by these petitioners, and a similarly situated co-accused had already been granted bail by this Court. These three bail applications arise out of the same police case and as such, these are being disposed of by this common order.

Heard the parties.

The petitioners have been made accused in connection with Jamtara Cyber Crime P.S. Case No.68 of 2023, for the offences under Sections 414, 419, 420, 467, 468, 471 & 120(B) of the Indian Penal Code and Sections 66(B), 66(C) & 66(D) of the Information Technology Act, pending in the court of learned Additional Sessions Judge-1^st , Jamtara.

Jamtara Cyber Crime Police on the basis of confidential information raided the house of one Basir Ansari and apprehended him alongwith co-accused persons, including these petitioners. On search, several mobile phones and other e-gadgets used in commission of cyber offence were recovered.

Learned counsel for the petitioners has submitted that no victim has turned up to say that he was cheated by these petitioners. It was further submitted that similarly situated co-accused person has been granted bail by this Court earlier.

Considering the aforesaid fact, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/-(Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-1^st , Jamtara, in connection with Jamtara Cyber Crime P.S. Case No.68 of 2023.
