Heard the parties.
The petitioner has been made accused in connection with Lawalong P.S. Case No.15 of 2022, for the offences registered under Sections 18, 27(a), 28 and 29 of the N.D.P.S. Act, pending in the court of learned Sessions Judge-cum-Special Judge, N.D.P.S. Cases, Chatra.
On 08.02.2022, Lawalong police on the basis of confidential information that poppy is being cultivated by the accused persons including the petitioner near Sulma protected forest area went to the place of occurrence and destroyed the poppy plantation.
The name of the petitioner has transpired on the basis of confidential information given by the villager whose names have not been revealed. It further appears that similarly situated co-accused person has been granted bail by Co-ordinate Bench of this Court vide B.A. No.3128 of 2021.
Learned A.P.P. has opposed the prayer for bail.
Considering the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge-cum-Special Judge, N.D.P.S. Cases, Chatra in connection with Lawalong P.S. Case No.15 of 2022.
