1. The present writ petition has been filed for following reliefs:-

“A. For issuance of an appropriate writ(s), order(s), direction(s) restraining the respondents from installing Electric Transmission Pole on petitioner raiyati agricultural land without any notice to the petitoners and assessment done; pertaining to Mauza Kandrapdih, P.O. Jainagar, P.S. No.65, District Koderma, Khata No.22, Plot No.709, Total Rakwa 1.6 acres on which approx. 32 decimals land is being forcibly encroached by the contractor without any information and legal procedure followed, which is the only source of livelihood of the petitioners by means of agriculture.

B. Stay of the work being done by the contractor on petitioners aforesaid mentioned raiyati has been directed by the respondents.”

2. Today, learned counsel for the respondent-railway is present before this Court and has submitted the Bank Cheque bearing No.173818 amounting Rs.47,160/- (Rupees Forty Seven Thousand One Hundred Sixty Only) dated 04.09.2023 for compensation of the said land.

3. The said Bank Cheque is hereby, handed over to the learned counsel for the petitioners to be forwarded to the petitioners. It is made clear that the said payment will not affect the rights of the parties.

4. The parties are at liberty to work out their remedy in accordance with law.
