The applicant who is in custody since 04.05.2023 has approached this Court for grant of regular bail in connection with Koderma P.S. Case No.54 of 2023 for the offence under Sections 406/ 420 of the Indian Penal Code.

Money of the maternal grand mother (Nani) of the co-accusedKaushal Kumar Rai has been withdrawn through UPI by playing fraud.

It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part.

Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. It has been submitted that on the basis of confession of the co-accused, namely, Kaushal Kumar Rai, this applicant has been made accused. The co-accused, namely Kaushal Kumar Rai was playing game in mobile phone of the victim (Nani) and during course of playing game, somebody has asked some information from him and innocently he has given the information which has ultimately resulted in cyber fraud. This applicant has no criminal antecedent. Further, the co-accused, namely, Kaushal Kumar Rai has already been enlarged on bail. On the above basis, prayer for bail has been made.

Learned A.P.P. has opposed the prayer for bail of the applicant.

Considering the above facts, the applicant, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Koderma in connection with Koderma P.S. Case No.54 of 2023, subject to condition that the applicant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
