06/11.07.2023 This criminal revision application has been filed on behalf of the petitioner challenging the order dated 25.01.2018 passed by learned Sessions Judge, Chatra in S. T. No. 255 of 16 arising out of Lawalong P. S. Case No. 33 of 2016 corresponding to G. R. No. 1053 of 2016 by which the petition filed under Section 319 of the Cr. P. C. has been rejected.

Heard learned counsel for the petitioner and learned counsel for the State and learned counsel for the opposite party nos. 2 and 3.

Perused the report sent vide Letter No. 341/2023 dated 27.06.2023 sent by Mr. Rakesh Kumar Singh, Sessions Judge, Chatra.

It appears from the report sent vide Letter No. 341/2023 dated 27.06.2023 sent by Mr. Rakesh Kumar Singh, Sessions Judge, Chatra that trial has already been concluded by way of conviction of two (2) accused persons namely Santosh Kumar Sahu and Khushiyali Sahu vide judgment dated 25.04.2018 and by the order of sentence dated 28.04.2018 and Lower Court Records have already been sent to this Court in Criminal Appeal (D.B.) No. 658 of 2018 read with Criminal Appeal (D.B.) No. 660 of 2018.

Thus, this Criminal Revision Application has become infructuous as trial has already been concluded.

In that view of the matter, learned counsel for the petitioner seeks permission to withdraw Criminal Revision No. 418 of 2018.

Accordingly, learned counsel for the petitioner is permitted to withdraw the instant Criminal Revision No. 418 of 2018.

Accordingly, the instant Criminal Revision No. 418 of 2018 is dismissed as withdrawn as having become infructuous.
