inasmuch as, on 8.11.2014 itself the rice of public distribution system was unloaded in the shop of this petitioner; that on being enquired, this petitioner disclosed to the villagers that the rice that was being unloaded was not of her shop, but she failed to reply as to why the rice was being unloaded; that the villagers disclosed that after the rice was unloaded, both the vehicles were released; that thereafter the villagers put lock in the rooms where the rice was kept and the same was opened only in presence of the officers, where it was found that in the west side of the building, total 98 bags of rice (47.46 quintals), out of which, 7 bags sewed by hand and 91 bags sewed by machine, were found; that in the adjacent room, 173 bags of rice (85 quintals approximately), out of which 49 bags of hand sewing and 124 bags of machine sewing were also found; that upon enquiry, it was found that 47.46 quintals rice were lifted to the petitioner on 8.11.2014 from SFC godown of Chouparan for distribution to consumer by the vehicle of Door Step Delivery Agent, Sri Ved Prakash; that it is alleged that no rice was sent on 9.11.2014 from the SFC godown for the petitioner; that the alleged recovered rice of 98 bags from 1st room and 173 bags from another was found to be excess; that it is alleged that on verification of the stock register, it was found that the entry of 46.46 quintals rice was made in the stock register; that it is further alleged that no paper relating to excess rice was produced before the inspecting authority by the petitioner, that the rice was seized in presence of the witnesses and seizure list was prepared.
