04/01.03.2023 The applicant who is in custody since 10.01.2015, has approached this Court for grant of regular bail in connection with S.T. No.334/2015 arising out of Parsudih P.S. Case No.372/2013, corresponding to G.R. Case No.4584/2013, for the offence under Sections 302/34 of IPC.
The applicant is an accused of committing murder.
It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part .
Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. It has been submitted by learned counsel for the applicant the applicant is not named in the F.I.R. and the named accused has faced the trial and he has been acquitted. The applicant has been roped in during investigation. On above basis, prayer for bail has been made.
Learned APP has opposed the prayer for bail of the applicant and submitted that cartridges have been recovered from the possession of this applicant.
A report has been called for from the court concerned.
From perusal of report, it appears that witnesses are still to be examined.
Considering the period of custody, I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-V, Jamshedpur in connection with S.T. No.334/2015 arising out of Parsudih P.S. Case No.372/2013, corresponding to G.R. Case No.4584/2013, on the condition that the applicant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
Trial court is directed to expedite the trial and conclude the same as soon as
possible.
