04/01.03.2023 The applicant who is in custody since 20.10.2022, has approached this Court for grant of regular bail in connection with Rajrappa P.S. Case No.203/2014, corresponding to G.R. Case No.5215/2014, for the offence under Sections 147/ 148/ 149/ 341/ 342/ 323/ 448/ 304/ 379/ 427/ 436/ 504/ 506 of IPC.
It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part .
The brother of the informant who is the owner of Vasundhara Vatika Hotel was sent to jail. In his absence, the informant was running the hotel. It has been alleged that on 29.12.2014, a mob had gathered demanding that the brother of the informant be hanged. The hotel was also damaged by the mob and it was set on fire.
The applicant has been attributed as the member of the mob. The allegations are general and omnibus in nature and several co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 15.01.2021 passed in A.B.A. No.6613 of 2020. On above basis, prayer for bail has been made.
Learned APP has opposed the prayer for bail of the applicant.
Considering the above facts, I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Ramgarh in connection with Rajrappa P.S. Case No.203/2014, corresponding to G.R. Case No.5215/2014, on the condition that the applicant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
