1. Heard learned counsel for the applicant and learned counsel or the State.

2. The applicant, who is in custody since 11.01.2023, has renewed the prayer for grant of bail in connection with Jamtara Cyber P.S. Case No.1 of 2023 (Cyber Case No.18 of 2023), registered for the offence under Sections 414/ 419/ 420/ 467/ 468/ 471/ 120B of the I.P.C and Section 66(B) (C) (D) of the I.T. Act.

3. It appears that this applicant has been made an accused for committing cyber crime.

Earlier, the bail application of this applicant was rejected vide order dated 15.05.2023, passed in B.A. No.2007 of 2023.

4. It has been submitted by the learned counsel for the applicant that complete set of F.I.R along with its enclosures have been annexed with the present bail application and there is no suppression on his part.

Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. It has been submitted that the charge has been framed on 27.04.2023 and till date out of twelve charge-sheeted witnesses only five have been examined. It has further been submitted that this applicant has no criminal antecedent. On the above basis, prayer for bail has been renewed. 5. Learned A.P.P has opposed the prayer for bail.

6. Considering the fact that no criminal antecedent has been reported against this applicant, I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge – I, Jamtara in connection with Jamtara Cyber P.S. Case No.1 of 2023 (Cyber Case No.18 of 2023), on the condition that the applicant will submit selfattested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
