1. Heard learned counsel for the applicant and learned A.P.P.
2. The applicant, who is in custody since 04.01.2023, has renewed the prayer for grant of bail in connection with Maheshpur P.S. Case No.1 of 2023, corresponding to Special POCSO Case No.9 of 2023.
3. It appears that this applicant has been made an accused for committing the offence under Sections 341/ 323/ 376/ 313 of the Indian Penal Code and Sections 4/ 6 of the POCSO Act.
Earlier, the bail application of this applicant was dismissed as withdrawn vide order dated 08.05.2023, passed in B.A. No.3403 of 2023.
4. It has been submitted by the learned counsel for the applicant that complete set of F.I.R along with its enclosures have been annexed with the present bail application and there is no suppression on his part.
Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. Referring to the statement of the victim girl, it has been submitted that the victim and this applicant got married as per the santhali custom and due to some marital dispute the present case has been lodged. It has further been submitted that the charge has already been framed. On the above basis, prayer for bail has been renewed.
5. Learned counsel for the State has opposed the prayer for bail. 6. Considering the fact that the charge has already been framed and further, looking into the statement of the victim girl, recorded under Section 164 Cr.P.C., I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge – I, Pakur in connection with Maheshpur P.S. Case No.1 of 2023, corresponding to Special POCSO Case No.9 of 2023, on the condition that the applicant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
