Heard both the sides.
The petitioner- Krishna Mandal @ Sonu is in custody since 22.08.2022 in connection with Kowali P.S. Case No. 34 of 2022 for the offence registered under Sections 365, 302, 201, 120B of the I.P.C. pending in the Court of learned J.M. 1st Class, Jamshedpur.
It is submitted by the learned counsel on behalf of petitioner that there is neither direct nor circumstantial evidence regarding complicity of this petitioner in the offence. The F.I.R. was lodged against unknown and the dead body was recovered after a month. The only material against this petitioner is the confessional statement of the co-accused.
Learned A.P.P. opposed the prayer for bail. It is submitted that matter involves contract killing and he was in touch with the main conspirator Mitali Mandal on her mobile and had arranged for the contract killing on a promised amount of Rs 80,000 and after receiving part payment. It has come in para 68 of the case diary that on the disclosure statement made by this petitioner, wearing apparels of the petitioner was recovered.
Considering the facts and circumstances of the case, the prayer for bail of the petitioner, is hereby, rejected.
