05/ 03.04.2023 . Petitioner above-named who is in custody since 29.08.2022 has moved this Court for grant of regular bail in connection with Dhanwar P.S. Case No.222 of 2022 registered under Sections 304(B)/ 34 of the Indian Penal Code.
Heard the parties.
It is submitted by learned counsel for the petitioner that it is a case of suicide and not homicide as it will be apparent from the post-mortem report. It is submitted that the deceased had marital discord with her husband and after having telephonic conversation on the mobile, the deceased committed suicide in which no overt-act has been attributed to this petitioner who happens to be mother-in-law.
Learned APP for the State assisted by learned counsel for the informant has vehemently opposed the prayer. It is submitted that there is specific allegation against the accused persons including the petitioner of demand of dowry.
Considering the submissions of learned counsel and the fact as discussed above, the bail application is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below.
