05/ 03.04.2023 . Petitioner above-named who is in custody since 08.12.2022 has moved this Court for grant of regular bail in connection with Chatra Sadar P.S. Case No.186 of 2018 (G.R. No.1021 of 2018) registered under Sections 395 & 397 of the Indian Penal Code.

Heard the parties.

As per the case of the prosecution, the matter involves dacoity committed in the house of the informant at night by 10-12 miscreants fully armed in their hands in which cash and valuables were looted.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR and he has also not been put on TIP and further there is no material against him except the confessional statement of co-accused. It is submitted that the petitioner has been remanded in this case from other case.

It is further submitted that petitioner being a Cultivator has never indulged himself in any illegal activities.

Learned APP for the State has vehemently opposed the prayer. It is submitted that the petitioner is a habitual offender and he does have three criminal antecedent of similar nature. It is submitted that after investigation, charge-sheet has been submitted.

Considering the gravity of offence and criminal antecedent, I am not inclined to enlarge the petitioner on regular bail and accordingly, the prayer for bail is rejected.

Learned Trial Court is directed to expedite the trial and conclude at the earliest preferably within a period of 9 months from the date of framing of charge. Thereafter the petitioner will be at liberty to renew his bail application.
