Dinesh Lohra Alias Dilesh Lohra Vs the State of Jharkhand

This is an application for grant of anticipatory bail in a case registered under Sections 414/34 of the Indian Penal Code, Section 30(ii) of the Coal Mines Act and Section 33 of the Indian Forest Act.

Allegation against the petitioner is that the police got information that the petitioners are indulged in illegal mining of coal from Kundra Protected Forest Area and when the raid was conducted, the petitioners fled away leaving their tractors.

Learned counsel for the petitioner has submitted that the petitioners are innocent and have been falsely implicated in this case; their names were disclosed by the villagers due to enmity; as a matter of fact, nothing incriminating was recovered from the seized tractors and the petitioners have no criminal antecedent.

Learned A.P.P. appearing for the State opposes the prayer for bail.

Considering the fact that the petitioners have no criminal antecedent, all the three petitioners, named above, are directed to be released on bail in the event of their surrender/arrest within four weeks from today in connection with Barkagaon P.S. Case No. 93 of 2022 on their furnishing bail bond of Rs.20000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Hazaribag, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
