Heard the Parties.
Petitioner is apprehending his arrest in connection with Balidih P.S. Case No. 75/2022, registered under Sections 414/ 272/ 273/ 406/ 420/ 467/ 468/ 471/120B/34 of the Indian Penal Code and Section 47(a) of the Excise Act and Section 63 of the Copyright Act, pending in the Court of learned S.D.J.M., Bokaro.
On 13.03.2022 at about 09:30 P.M., informant party raided an abandoned house near Godabali and seized huge quantity of English liquor.
It appears that the name of this petitioner has transpired on the basis of confidential information given by witnesses whose names have not been disclosed by the prosecution.
Similarly situated co-accused person namely, Nemay Mandal has been granted Anticipatory Bail by this Court earlier vide A.B.A. No.4519 of 2022 and case of the petitioner stands on similar footing.
Learned A.P.P. has opposed the prayer for Anticipatory Bail.
Regard being had to the facts and circumstance of the case, I am inclined to extend the privilege of Anticipatory Bail to the petitioner. He is directed to surrender before the court below within two weeks from the date of receipt/production of copy of this order, and in the event of his arrest or surrender he shall be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Bokaro in connection with Balidih P.S. Case No. 75/2022, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
