Petitioner is apprehending his arrest in connection with Gumla P. S. Case No. 395/2022, registered under Sections 147/ 148/ 149/ 448/ 323/ 325/ 307 of the Indian Penal Code, pending in the Court of learned C.J.M., Gumla.
Petitioner co-accused Amit Gope are alleged to have assaulted the informant on the ground that father of the informant had shot the brother of Amit Gope. It was submitted that there is case and counter case between the parties and the informant had sustained simple injuries. Similarly situated co-accused has been granted anticipatory bail by this court vide A.B.A. No. 3176/2023 and the case of the petitioner stands on similar footing.
Regard being had to the facts and circumstance of the case; I am inclined to extend the privilege of Anticipatory Bail to the petitioner. He is directed to surrender before the court below within two weeks from the date of receipt of copy of this order and learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gumla in connection with Gumla P. S. Case No. 395/2022, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
