Petitioner is apprehending his arrest in connection with Lalpur P.S. Case No. 101/2022 for the offences registered under sections 406/420 of the Indian Penal Code, pending in the court of Sri Raj Kumar Pandey, learned J.M.F.C, Ranchi.

Petitioner is said to have entered into an agreement with the Informant for sale of 8.01 acres of land, for which Rs. 2.38 crore was paid to him.

It appears that the petitioner had transferred about 2.00 acres of land to the Informant, but the remaining land could not be transferred. It further transpires that 2.00 acres of land which was transferred to the petitioner was disputed land and the case was sub-judice before the competent civil court.

Mr. Avishek Prasad, learned counsel appearing for the petitioner, submitted that parties have settled their dispute.

This fact has been confirmed by Mr. Shubham Choudhary, learned counsel appearing for the Informant.

Present case has been instituted for the offences under sections 406/420

I.P.C. which are compoundable in nature.

Considering the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, petitioner, above named, is directed to surrender before the learned court below within two weeks from the date of receipt of a copy of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bonds of Rs. 25,000/(Rupees twenty five thousand) with two sureties of the like amount each, to the satisfaction of Sri Raj Kumar Pandey, learned J.M.F.C, Ranchi in connection with Lalpur P.S. Case No. 101/2022, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
