The present writ petition has been filed for issuance of direction upon the respondents to hold that the appeal preferred by the respondent no.3- Kishore Narone being H.R.C.A. No.04 of 2021-22 against the order dated 4th October, 2021 passed by the respondent no.2 in Jharkhand Building Act Case no.2 of 2019 is not maintainable in terms with the provision of Section 21(8) of the Jharkhand Buildings (Lease, Rent & Eviction) Control Act, 2011. Further prayer has been made for quashing the order dated 4th December, 2021 (Annexure-7 to the writ petition) passed by the Deputy Commissioner, Deogharthe respondent no.1 in H.R.C.A. No.04 of 2021-22, whereby the operation of the order dated 4th October, 2021 (Annexure-4 to the writ petition) passed by the Rent Controller-cum-Sub Divisional Officer, Deoghar-respondent no.2 has been stayed and has further passed the order of status quo as existing prior to passing of the execution order dated 27th November,2021. The petitioners have also prayed for issuance of direction upon the respondents not to give effect of the order dated 4th December, 2021 passed by the respondent no.1 in the aforesaid appeal.
