W.P.(C) No. 2889/2021 has been filed for issuance of direction upon the respondent Nos. 2 & 3 to allow the petitioners to appear in the special examination for left out students and special internal examination for the first year (Session 2019-20) of B.Ed. course conducted by the respondent No.3 as per minutes of meeting dated 28.01.2021 (Annexure-2 to the said writ petition) whereas W.P.(C) No. 3703/2021 has been filed for issuance of direction upon the said respondents to allow the petitioners to appear in the second year examination of the B.Ed. course (Session 2019-20).

It is jointly submitted by Mr. Prem Mardi, learned counsel for the petitioners and Mr. Amit Kumar, learned A.C to Mr. Indrajit Sinha, learned counsel for the respondent No.3, that the misunderstanding/dispute between the petitioners and the respondent No.3 has now been amicably resolved.

Learned counsel for the respondent No.3 submits that the respondent No.3 has got no objection to the prayers made by the petitioners in both the writ petitions. It is however clarified that at the request of the petitioners, it was earlier resolved in the minutes of meeting dated 28.01.2021 held under the Chairmanship of the Pro-Vice Chancellor of Ranchi University that the internal examination will be conducted on the orders of Pro-Vice Chancellor, Ranchi University and marking will be done by outside B.Ed. faculties of different colleges.

Mr. Prem Mardi, learned counsel for the petitioners, on instruction, submits that the petitioners have got no objection, if the internal examination papers are evaluated by the faculties of the respondent No.3.

Dr. Ashok Kumar Singh, learned counsel for the respondent No.2, submits that once the internal examination of the petitioners is conducted at the instance of the respondent No.3, the respondent No.2 will conduct the special examination of the petitioners for both the first and second year of B.Ed. course.

Keeping in view that the misunderstanding/dispute between the petitioners and the college administration (the respondent No.3) has now been resolved, the present writ petitions are disposed of with the following order:-

(i) The respondent No.3 shall take special internal examination of the petitioners for the first year B.Ed. course (Session 2019-20) within fifteen days from the date of communication of this order and the result of the said examination shall be published within 15 days thereafter.

(ii) The respondent No.2 shall take appropriate steps for conducting the special external examination of the petitioners for the first year B.Ed. course (Session 2019-20) within one month thereafter, the

result of which shall be published within 15 days of conducting the said examination.

(iii) If the petitioners are declared to have passed in the first year examination, the respondent No.3 shall conduct the special internal examination for the second year B.Ed. course (Session 2019-20) within one month of publication of result of first year examination by the respondent No.2 and the result of the said examination shall be declared within 15 days thereafter.

(iv) The respondent No.2 shall take appropriate steps for conducting the special external examination of the petitioners for the second year B.Ed. course (Session 2019-20) within one month thereafter, the result of which shall be published within 15 days of conducting the said examination.
