“8. PW-1 Sanjay Kumar Gadyan is plaintiff himself and he has stated in his evidence that his marriage was solemnized with the defendant on 17/04/1998 at Jamtara but since after the marriage, defendant did not allow him to consummate the marriage with one false pretext to the other and after three months of marriage, defendant went to her Maika at Jamtara. It has further been alleged that on the death of his grand motherin-law, plaintiff went to the Maika of defendant where he had seen his wife/defendant with her brother-in-law Naresh Modi in an objectionable condition and he also came to know that Naresh Modi was married with the elder sister of defendant namely Anita Lachiramka and she died due to burn injury and thereafter, both defendant and Naresh Modi came to physical relationship. He has further stated that plaintiff managed to keep her but by passing of time the defendant started torturing the plaintiff with various means and she also extended threat to implicate his entire family members in a dowry death case. It has further been alleged that due to the alleged illicit relationship of defendant, his family members have left the house and went on to reside in a rented house thereafter, in his absence, defendant started enjoying illicit relationship with Naresh Modi regularly. He has further stated that, his wife/defendant gave birth to a male child on 15/08/1999 and also a female child on 07/09/2009 whereas at no point of time he was allowed to cohabit by the defendant. He has further stated that on 21/07/2016 he had filed a compliant before the competent authority with regard to the torture of defendant and after knowing the fact, defendant had lodged Jamtara PS Case No. 212/16 against him which was ended on compromise thereafter, defendant came to is house from where, she tried to eliminate him by hatching conspiracy with Naresh Modi. He has further stated that he found himself ill day by day and when he went to the doctor Manoj Kumar Sudarnia, he was sent for pathological test and the reports reveals that his kidney were infected by Oxalic Acid which was mixed in his food by his wife and he had also found bottle of oxalic acid in the kitchen. He reported the matter to Chirkunda PS on 23/03/2017 whereupon on 25/06/2017 at about 4:00 PM defendant forcefully entered in
