In spite of information given to the victim, nobody appears on behalf of

the victim to participate in the proceeding.

The present appeal has been filed under Section 14(A) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act.

The appellant who is in custody since 17.10.2020 has approached this Court against the order dated 20.01.2021 passed by the learned A.J.C.-VII-cum-Spl. Judge, SC/ST, Ranchi in M.C.A. No.69 of 2021 (SC/ST No.52 of 2020), registered for the offence under Sections 376 of IPC and Section 3 (2)(Va) of SC/ST (PoA) Act by which prayer for bail of the appellant has been rejected.

It has been submitted by learned counsel for the appellant that the appellant undertakes to participate in the trial. Further innocence has been claimed. On above facts, prayer for bail has been made.

On the other hand, learned APP has opposed the prayer for bail.

From perusal of record, it appears that charge has already been framed on 08.02.2021 but till date no prosecution witness has been examined. Although four witnesses have been shown in charge-sheet.

Considering the period of custody, the appellant, above named, is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Ten Thousand), with two sureties of the like amount each, to the satisfaction of learned A.J.C.-VII-cumSpl. Judge, SC/ST, Ranchi in Kanke P.S. Case No.145 of 2020 (SC/ST No.52 of 2020) subject to condition that the appellant will submit self-attested photocopy of his Aadhar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.

Accordingly, instant criminal appeal is allowed.
