04/ 12.04.2022 Heard Mr. Amit Kumar, learned counsel appearing for the petitioner and Mr. Ravi Prakash, learned Spl.P.P. for the State.

This criminal miscellaneous petition has been filed for

quashing of the order dated 07.12.2021, whereby, the bail of the petitioner has been cancelled and non-bailable warrant of arrest has been issued, in connection with Maranghada P.S. Case No. 04 of 2019 corresponding to N.D.P.S. Case No. 12 of 2019, pending in the Court of learned Additional Sessions Judge-II, Khunti.

Learned counsel appearing for the petitioner submits that the representation of the petitioner under Section 317 Cr.P.C. has been filed, in spite of that the learned Court has cancelled the bail of the petitioner.

Learned Spl.P.P. appearing for the State submits that the case was fixed for framing of charge, but the petitioner has not appeared that’s why his bail has been cancelled.

In view of the above facts and considering that the petitioner was already on bail and in the interest of justice, the petitioner is directed to appear in the concerned Court on the date fixed by this Court.

Accordingly, the petitioner is directed to appear before the concerned court on or before 25.04.2022. If the petitioner shall appear on or before that date, the petitioner shall be allowed to remain on the same bail bond, which has been cancelled by the concerned court. It is made clear that on failure of appearance by the petitioner, the Court below shall take all coercive action against the petitioner.

With the above direction, this criminal miscellaneous petition stands disposed of.
