Heard Mr. R.C.P. Sah, learned counsel for the petitioner and Mrs. Abhay Kumar Tiwari, learned counsel for the State.

This petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic. None of the parties have complained about any technical snag of audio-video and with their consent this matter has been heard.

The present petition has been filed for quashing of cognizance order dated 10.11.2018 including entire criminal proceeding in connection with Adityapur P.S. Case No. 253 of 2018, corresponding to G.R. Case No. 827 of 2018 pending in the Court of learned Chief Judicial Magistrate, Seraikella.

The complaint was filed by the complainant namely Abni Das alleging therein that the marriage of his daughter-Geeta Devi was solemnized on 05.03.2018 with one Abhishek Das. It is further alleged that since the time of marriage all the accused persons started torturing his daughter for dowry. It is further alleged that his son-in-law has illicit relationship with the petitioner. When his daughter became pregnant then Abhishek Das deliberately caused miscarriage by assaulting her and lastly his daughter has been killed by the accused persons and hanged her by them to conceal the evidence.

Mr. R.C.P. Sah, learned counsel for the petitioner submits that

there is no direct allegation against the petitioner. He submits that after investigation chargehsheet has been submitted against the petitioner thereafter the learned court below took cognizance.

In this petition cognizance order including F.I.R. is under challenge. There are allegations against the petitioner who happens to be the sister-in-law of the deceased. What are the materials in the charge sheet that is not before this Court. This is not a case to exercise its power under section 482 Cr.P.C. Accordingly, this criminal miscellaneous petition is hereby dismissed.
