Learned counsel for the applicant has submitted that the First Information Report of this case was lodged by the victim herself with the allegations that her husband was at abroad and the accused Sandeep Kumar Rajak came to her contact in the year 2017 and the affairs between the two developed into physical relationships, on account of having nude videos of the victim and with the threatening that he would made the same viral. The accused-applicant Shankar Pandey also committed rape upon her on account of the same ground and both the accused persons also extorted the money of Rs.1,90,000/- from her account and Rs.1,50,000/- was paid by her out of the proceeds of jewelry, which was sold by her. Learned counsel for the applicant has submitted that the informant-victim was major having 39 years of age and as per First Information Report’s allegations, the nude photographs were clicked by the co-accused Sandeep Kumar Rajak in the year 2017 and on the basis of the nude photographs/videos Sandeep Kumar Rajak and the present applicant had been sexually exploiting her but no F.I.R. was lodged by her for a period of four years for which there is no cogent explanation on record.
