This bail application has been filed on behalf of the applicant– Dilip Saw @ Dilip Prasad with prayer to release on bail in connection with Bhandariya P.S. Case No.29 of 2009 registered under Sections 380/452 of the Indian Penal Code and Section 17 of the CLA Act pending in the court of learned Chief Judicial Magistrate, Garhwa.

Learned counsel for the applicant has submitted that the F.I.R. of this case lodged by the informant against the two named accused persons including the applicant with the allegations that these accused persons intruded in the house of the informant and after threatening his wife had looted away the motorcycle of the informant. Though, the applicant has been named in the F.I.R., yet nothing incriminating article was recovered from his possession. The offence alleged is triable by the Court of Magistrate. The applicant has been languishing in jail since 15.03.2021.

Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant and contended that the applicant is having criminal antecedent and is the member of extremist group.

In view of the submissions made and material on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount to the satisfaction of the court of learned Chief Judicial Magistrate, Garhwa in aforesaid case.
