This bail application has been filed on behalf of the applicant– Karamchand @ Karam Manjhi @ Karmu Soren with prayer to release on bail in connection with Shikaripara P.S. Case No.121 of 2009 registered under Sections 147/148/149/307/302/379 of the Indian Penal Code, Section 27 of the Arms Act, Section 17 of the CLA Act and Section 13 of the UAP Act pending in the court of learned Additional Sessions Judge-III, Dumka.

Learned counsel for the applicant has submitted that the F.I.R. of this case lodged in the year 2009 by the informant against the 16-20 unknown extremists, who assaulted BSF personnel during the election polling and the fires were opened from both the sides in which two constables of the BSF died and service carbine machine gun, Motorola wireless set with Antenna and battery, service SLR with cartridges were also looted. It is further submitted that after ten years of the occurrence, the name of the applicant transpired and there is no evidence against the applicant in regard being involved in commission of the alleged offence. Similarly, situated co-accused Govind Marandi @ Gobind Marandi and Chunda Hembrom have already been granted bail by a co-ordinate Bench of this Court vide orders dated 27.09.2019 and 27.11.2019 passed in B.A. Nos.4598 of 2019 and 10161 of 2019 respectively. The applicant has been languishing in jail since 23.04.2019.

Learned A.P.P. appearing on behalf of the State vehemently

opposed the contentions made by the learned counsel for the applicant.

In view of the submissions made and material on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.30,000/-(Rupees Thirty Thousand) with two sureties of the like amount to the satisfaction of the court of learned Additional Sessions Judge-III, Dumka in aforesaid case.
